Codes & Registers

Council employees and Elected Members must comply with the provisions of a Code of Conduct in carrying out their functions as public officials.  Council provide trainings and education opportunities that will assist employees to meet their responsibilities under the Local Government Act 1999.

The Codes of Conduct are mandatory and apply to Council employees and Elected Members from any Council in South Australia.  The codes are available below.

The Code of Conduct contains information about how to manage gifts and benefits that are received in offical duties.  A register of gifts and benefits is maintained. 

Code of Conduct

The Governor may, by regulation, prescribe a code of conduct to be observed by the members of all councils.  Council members must observe the code of conduct.  The Code of Conduct states that a member of a council must at all times act honestly and with reasonable care and diligence in the performance and discharge of official functions and duties.

Council Employees must also observe a Code of Conduct.  An employee of Council must at all times act honestly and with reasonable care and diligence in the performance and discharge of official functions and duties.

Gifts and Benefits Registers

Council Members who receive a gift or benefit of more than $100 (as published in the Government Gazette by the Minister) must ensure that details of each gift are recorded with in the Elected Members Gifts and Benefits Register. This register is also available for inspection at the principal office of the Council.

Employees who receive a gift or benefit of $100 or more (as published in the Government Gazette by the Minister), must ensure that details of each gift are recorded within the Staff Gifts and Benefits Register. This register is also available for inspection at the principal office of the Council

 

Elected Member Register of Interest Information

Under Section 70(a1) of the Local Government Act 1999, the Council must publish on the website, in accordance with the regulations, the following details about a Council member as recorded in the Register of Interests:

  • the member's income sources (within the meaning of Schedule 3 to the Local Government Act) or employer;
  • the name of any political party, any body or association formed for political purposes or any trade or professional organisation (within the meaning of Schedule 3) of which the member is a member;
  • any gifts received by the member that are required to be included in the information entered in the Register in relation to the member.

Declaration of Conflicts of Interest – Elected Members

Under section 74(5) & 75A(4) of the Local Government Act 1999, Council must record on the website details regarding disclosures of material, actual or perceived conflicts of interest during a meeting of the council.  The following details will be recorded on the City of Port Adelaide Enfield website:

  • The member’s name
  • The nature of the interest, as described by the member
  • If the member took part in the meeting with the actual or perceived conflict of interest
  • The manner in which the member dealt with the actual or perceived conflict of interest
  • If the member voted on the matter, the manner in which he or she voted
  • The manner in which the majority of person who were entitled to vote at the meeting voted on the matter
